Cancellation Policy

1. General This policy applies to all applicants and holders of boat pen licences at Marina Quays. By submitting an application or occupying a pen, the Pen Holder agrees to comply with this policy, the Licence Agreement, Marina Rules and Regulations, and all applicable laws. 2. Fees and Charges All fees and charges for boat pens are GST inclusive. Pens are allocated subject to availability and acceptance of the application. 3. Licence and Compliance Pen licences are issued subject to: The terms and conditions of the Licence Agreement Marina Rules and Regulations Waterways in the City/Shire of Exmouth Local Law A Certificate of Public Liability Insurance with a minimum cover of $10 million must be provided with the completed application form and maintained for the duration of the licence. 4. Vessel Size and Access The overall length of the vessel, including bowsprits, marlin boards, outboards, tenders, or any other attachments, must not exceed the stated length of the allocated pen. The marina has a bridge height clearance of 6.0 metres at Highest Astronomical Tide (H.A.T.). It is the responsibility of the vessel owner to ensure their vessel can safely pass under the bridge. 5. Services and Utilities No power or water is provided at the boat pens. 6. Overnight Stays Pen Holders are permitted to stay overnight on their vessel for up to 20 nights per calendar year, subject to the terms and conditions of the licence and all applicable marina rules. 7. Gas Compliance Vessels carrying gas onboard must provide a current Gas Compliance Certificate. Gas Compliance Certificates must be renewed every five (5) years. 8. Allocation and Use Boat pens are allocated at the discretion of the marina management and are subject to availability. Pens may only be used for the vessel approved under the licence and must not be sublet or transferred without written approval. 9. Responsibility of Pen Holders Pen Holders are responsible for ensuring their vessel is maintained in a safe, seaworthy, and tidy condition at all times. All activities must be conducted in a manner that does not interfere with other marina users or compromise safety.
